1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and MCA DESIGN LTD (referred to as "we", "us", or "our") concerning your access to and use of the Daily Creative Challenge mobile application, our websites, and other products or services.

2. Intellectual Property Rights

Unless otherwise indicated, our applications and websites are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

3. User-Generated Creative Output

Our applications provide prompts to inspire your creativity. You retain full and exclusive ownership of any creative works, drawings, writings, films, photographs, or ideas you produce in response to these prompts. You are free to use, distribute, sell, or publish your creative output without any royalty or obligation to MCA DESIGN LTD.

4. Permitted Use & Restrictions

You are granted a limited, non-exclusive, non-transferable, revocable license to use our applications strictly for your personal, non-commercial entertainment and habit-building purposes. You agree not to copy, reverse-engineer, modify, or distribute the application's source code or content for commercial gain without prior written consent from MCA DESIGN LTD.

5. Service Availability & Modifications

We strive to keep our services functional and available. However, we reserve the right to change, modify, update, suspend, or discontinue our applications or any part of our prompt libraries at any time without notice or liability.

6. Disclaimer of Warranties

Our services are provided on an "as-is" and "as-available" basis. You agree that your use of the application services will be at your sole risk. To the fullest extent permitted by law, MCA DESIGN LTD disclaims all warranties, express or implied, in connection with the services and your use thereof.

7. Limitation of Liability

In no event will MCA DESIGN LTD, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the application or website.

8. Governing Law & Dispute Resolution

These terms shall be governed by and defined following the laws of the United Kingdom (specifically England and Wales). MCA DESIGN LTD and yourself irrevocably consent that the courts of the United Kingdom shall have exclusive jurisdiction to resolve any dispute.
